MRICOHR's MasterPlan division was found liable for breach of contract, negligence and negligent representation as a result of its failure to complete the installation of a MRI machine for Wilshire Radiology.

Alex Weingarten of Spillane Weingarten LLP , a California based business litigation law firm, won a unanimous jury verdict in Los Angeles Superior Court on behalf of medical imaging center Wilshire Radiology MRI, Inc., against COHR, Inc., a large national conglomerate providing a broad range of services across the health care industry.

After a two week trial, the jury took less than three hours to deliberate, awarding lost profits and other damages against COHR. COHR had also filed counterclaims against Wilshire Radiology for breach of contract, fraud and other similar claims, all of which were rejected by the jury as part of its verdict. Including anticipated recovery of costs and pre-judgment interest, the judgment will be in an amount in excess of $800,000.

"We are delighted with the outcome and grateful for the amazing job that Alex and his team did at trial," said Wilshire Radiology CEO Alan Kleinman. "Alex owned the courtroom from the moment he began his opening statement to the end of his closing argument, and there was little doubt that he was going to win this case for us. I heard that Alex was the lawyer to call for a 'bet the company' case, and he was even better than advertised. I was simply blown away and obviously so was the jury."

Wilshire Radiology hired COHR, a leader in the industry, in December 2006 to install its MRI machine. The job was to be completed in three weeks but more than a year later, COHR had failed to make any progress and even suggested that Wilshire scrap the MRI for a new one. Wilshire hired another firm, and the installation was completed in three weeks.
